1. About Unfettered

Unfettered ("we," "us," or "our") provides AI-powered educational services to incarcerated individuals through email correspondence. Our mission is to support education, personal growth, rehabilitation, and successful reentry into society. By using the Unfettered service (the "Service"), you agree to these Terms of Use.

2. Purpose and Scope

The Service is designed exclusively for educational and personal development purposes. Unfettered provides guided learning paths covering subjects such as literature, history, philosophy, science, and practical life skills. The Service is intended to foster constructive learning, self-reflection, and preparation for successful reentry.

Unfettered is not a legal service, a mental health provider, or a substitute for professional counseling. If you are in crisis, please contact the appropriate facility staff or emergency services.

3. How the Service Works

Correspondence with Unfettered is processed by artificial intelligence (AI) systems and may also be reviewed by Unfettered staff members. You should understand that:

• Your emails are read and responded to by AI. A human being is not composing your replies, though Unfettered staff may review correspondence for quality assurance and safety purposes.
• AI-generated responses, while carefully designed for educational value, may occasionally contain errors. Unfettered does not guarantee the accuracy of every response.
• The Service is provided through email systems operated by correctional facilities. Unfettered does not control facility email systems, delivery timing, or availability.

4. Communication Monitoring and Safety

Users of correctional facility email systems are already subject to monitoring by facility authorities under applicable facility policies and law. Unfettered operates within this context and applies its own review processes as described below.

Automated content review:

All inbound and outbound correspondence is subject to automated content filtering. These filters are designed to maintain the educational nature of the Service and to identify communications that may indicate a safety concern.

Safety-related disclosures:

Unfettered may alert correctional facility authorities or other appropriate parties if correspondence contains content indicating:

• Expressions of suicidal ideation or intent to self-harm
• Threats of violence toward oneself or others
• Plans to commit crimes or escape
• Other content that poses a credible risk to the safety of any person

We believe transparency about this process is essential. These measures exist to protect the well-being of users and the broader community. Unfettered does not engage in monitoring for purposes unrelated to user safety or the educational mission of the Service.

5. Acceptable Use

The Service is provided for educational engagement. Users agree to use the Service in good faith for its intended purpose. The following uses are prohibited:

• Using the Service to facilitate illegal activity or to circumvent facility rules
• Sending threatening, harassing, or abusive content
• Attempting to manipulate the AI system for purposes other than education
• Using the Service to send messages to or communicate with third parties

Unfettered reserves the right to suspend or terminate access to the Service for violations of these terms.

6. Correspondence and Intellectual Property

When you send correspondence to Unfettered, you retain authorship of your original creative expression (such as essays, poems, stories, or reflections you compose). However, by using the Service, you grant Unfettered a perpetual, worldwide, royalty-free, irrevocable license to:

• Store, process, and analyze your correspondence to operate and improve the Service
• Use correspondence in de-identified or aggregated form for research, program evaluation, and educational purposes (see Section 7)
• Share correspondence with facility authorities as described in Section 4

All AI-generated content, learning materials, system prompts, and other materials created by Unfettered are the intellectual property of Unfettered.

7. Research and Data Use

Unfettered is committed to advancing the understanding of educational outcomes, rehabilitation, and personal development for incarcerated individuals. To that end, correspondence and usage data may be used in the following ways:

• Program improvement: Analyzing patterns in correspondence helps us refine our learning paths, improve AI responses, and better serve users.
• Research and analysis: De-identified or aggregated data may be shared with research partners to study educational engagement, learning outcomes, and the experiences of incarcerated individuals. This research aims to contribute to evidence-based approaches to education and rehabilitation.
• Reporting and advocacy: Aggregate insights may be used in reports, publications, or advocacy efforts to support improved educational access for incarcerated populations.

When correspondence is used for research or shared with partners, we will take reasonable steps to de-identify personal information. No individual user will be publicly identified in research outputs without their explicit written consent.

8. Subscriptions and Payment

Access to the Service is provided through subscriptions purchased by supporters (friends, family, advocates) on behalf of incarcerated individuals. Subscription terms, pricing, and cancellation policies are presented at the time of purchase. Payments are processed by Stripe, a third-party payment processor, and are subject to Stripe's terms of service.

9. Service Availability

Unfettered strives to provide reliable service but does not guarantee uninterrupted availability. Service may be affected by:

• Facility email system outages or restrictions
• Scheduled or unscheduled maintenance
• Circumstances beyond our reasonable control

We will make reasonable efforts to minimize disruptions and to communicate about known service interruptions.

10. Limitation of Liability

The Service is provided "as is" and "as available." To the fullest extent permitted by applicable law, Unfettered disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Unfettered shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount paid for the subscription in the twelve months preceding the claim.

11. Changes to These Terms

We may update these Terms of Use from time to time. When we make material changes, we will update the effective date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

12. Termination

Unfettered may suspend or terminate a user's access to the Service at any time for violation of these Terms or for any other reason consistent with our mission and obligations. Supporters may cancel subscriptions at any time through the subscription management page.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions.
